1:15-CV-01288 Update on My Case and Other Matters

On June 7th, 2016, Judge Colleen Kollar-Kotelly denied my “Rule 59 Motion to Alter/Amend Dismissal and for Oral Argument”, claiming the Anti-Injunction Act (AIA) is jurisdictional and that “Plaintiff has not established extraordinary circumstances warranting relief from final judgment”.  In my Rule 59 Motion, I argued that under “extraordinary circumstances”, the AIA DOES allow the Court to invoke its equity jurisdiction and that the IRS’ institutionalized IMF record falsification scheme DOES establish “extraordinary circumstances” warranting relief from final judgment.

On August 2, 2016, I filed a “Notice of Appeal” in the District Court of the United States For the District of Columbia.  Document 019 will be uploaded to this website soon.

This battle will continue.


In other news, the NINTH Plaintiff has filed his case in Federal court in Washington, D.C., citing similar IRS fraud as mine and the others.

As you can see, in addition to the IRS Commissioner and U.S. Attorney General (in their official capacities), the most recent Plaintiffs have begun suing DoJ attorneys and Federal court clerks in their personal capacities, for concealing the fraud.

There are more Plaintiffs in the queue waiting to file their cases and others are welcomed to join the Class.

We are keeping the pressure on the Judges to do the right thing, which is to invoke their equity jurisdiction, hear these cases on their merits, and enjoin the fraud.  To date, not one judge has done so, an indication that the IRS, DoJ, court clerks, and Federal judges are acting in collusion to keep the fraud alive, allowing the IRS to continue destroying the lives of an untold number of innocent Americans in the process.


In further exciting news, a doctor in California filed suit against the California Franchise Tax Board (FTB) for claiming he owes more than $400,000 in State income taxes.  The FTB also published his name on a public “shaming” list, which caused him to lose his medical license, his clinic, and his patients, destroying his lucrative practice.  He asked for my help, so, I examined his evidence and wrote an “expert witness” report, which his attorney filed in the Federal District Court in Los Angeles on July 22nd.

Using my 40 years of accounting and corporate auditing skills, I calculated that the FTB’s actions damaged the doctor by more than $400 MILLION for the loss of his investment in his clinic, loss of future earnings, and loss of his reputation and standing in the community.  He is only 50 years old and has a long career ahead him.

In the report, I also included my personal knowledge that State taxing authorities rely on fraudulent IRS data to assess taxes on people at the State level, which means those assessments are fraudulent, as well.

I was scheduled to attend a mediation meeting in Los Angeles on August 11th, but, received this email from the doctor the other day:


Hi Bob,

Just found out that only parties to the suit can be at the mediation.

We got the Attorney General’s office pretty riled up over your report.

They attempted to negotiate, over this past weekend, that neither party would use Experts in their defense, which I of course decline to do.

They are now attempting this week to submit Motions in Limine to limit your testimony and report to only relevant facts…. facts that don’t include the IRS FTB Fraud scenarios.

They are also attempting to disqualify you as an expert witness for lack of qualification.

These are exciting times, with far-reaching implications for the future of America, and I am proud to be standing tall on the front lines, facing down the criminals who are working in concert to keep “We the People” enslaved by our 104 year old corrupt, confiscatory, Progressive income tax system, which did not exist until 1913.

If the IRS cannot enforce the income tax laws without committing fraud, then it has no legal enforcement power at all.

When 320 million Americans realize that fact, it will set the stage for a tax revolt, similar to the one that sparked the 1st American Revolution in 1775.  This time, however, there will be no need for armed conflict to shrink our out-of-control Federal government down to its Constitutional size and scope.  We will simply defund it until Congress repeals the laws that have enslaved us.

I hope you will continue to follow these cases as each courageous Plaintiff battles the forces of evil within our government.

Remember, no American born after 1913 has experienced life at the level of liberty and prosperity intended by the Founding Fathers.  We, the Plaintiffs, are putting ourselves at risk so you, your families, and future generations of Americans can do so.

I check in every month or so to see how you are doing. Great to see that you are still at it. We are not a vocal group but there are a lot of us in the tax honesty movement and we wish you all the best.
